The terms and conditions ("Terms") below govern your use of the IndEx Card UK website: www.index-card.co.uk ("the Website"). Please read these Terms carefully and ensure that you have understood them. If you do not agree to these Terms, do not use the Website and please cease use of the Website immediately. If you do use the website, your conduct indicates that you agree to be bound by the terms and conditions and do not hold IndEx Card, IndEx Card UK or any of its employees, directors or shareholders accountable for any information contained or not contained within the website and any services that it provides.
If you take our Eligibility Check on the Website we will ask you to expressly agree to the privacy policy. If you are approved and sign up to the Website as a member we will ask you to expressly agree to these terms.
Our website uses cookies. By using our website and agreeing to these terms of use, you consent to our use of cookies in accordance with the terms of our privacy policy / cookies policy.
1. Definitions
1.1 “IndEx” and “IndEx Card" is the trading name of and, for the purposes of these Terms, means IndEx Card UK.
1.2 "User" means any person who visits or uses the Website;
1.3 “Members” means any person who is a verified and paid member and has access to discounts and offers on the Website.
2. IndEx Card
2.1 The Website is owned and managed by IndEx Card UK. All information supplied on the Website is managed by IndEx Card UK.
2.2 IndEx Card UK can be contacted through our contact page or through email support@indexcard.co.uk.
3. Use of the Website
3.1 By visiting and using the Website you warrant that you are 18 years old or above and have the right, authority and capacity to enter into and be bound by these Terms and that you agree to be bound by these Terms immediately.
3.2 You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
3.3 You must not use our website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
3.4 You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our website without our express written consent.
3.5 In the event that IndEx Card, in its sole discretion, considers that you are making any illegal and/or unauthorised use of the Website, and/or your use of the Website is in breach of these Terms, IndEx Card reserves the right to take any action that it deems necessary, including terminating without notice your use of the Website and, in the case of illegal use, instigating legal proceedings.
3.6 IndEx Card may suspend the Website at any time and for any reason whatsoever, including but not limited to repairs, planned maintenance or upgrades, and shall not be liable to you for any such suspension.
3.7 IndEx Card reserves the right to make any changes to the Website or to discontinue any aspect or feature of the Website without notice to Users.
3.8 The IndEx Card Website contains links to third party websites that are not maintained or controlled by IndEx Card UK. Whilst IndEx Card does pick its companies carefully it cannot be held liable for any material on these sites and any illegal or wrong information on these sites.
3.9 We do not guarantee that the Website will be secure or free from bugs or viruses.
3.10 You are responsible for configuring your information technology, computer programmes and platform to access the Site. You should use your own virus protection software.
3.11 IndEx Card actively audits and approves content that goes live on the Website, however there may be instances where an individual deems a piece of our content to be offensive or inappropriate. In this case, please immediately email support@indexcard.co.uk] to notify us. Accordingly, IndEx Card will NOT process, digitize, post, upload, store, share or otherwise display on the Website:

Content or material that we believe is pornographic, obscene, or of an adult or sexual nature;

Content or material that we believe is offensive, obscene or inflammatory, including but not limited to, expressions of bigotry, prejudice, racism, hatred and profanity;

Content or material that exploits children under the age of 18 or posts or discloses any personally identifying information about children under the age of 18;

Content or material promoting or providing instructional information about illegal activities, promoting harm or injury to any group, individual or cruelty to animals

Content or material that is defamatory of any person;

Content or material that promotes violence;

Content or material that promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

Content or material that is likely to deceive any person;

Content or material that we that breaches any legal duty owed to a third party, such as a contractual duty or a duty of confidence;

Content or material that we believe likely to harass, upset, embarrass, alarm or annoy any other person;

Copyrighted content or material that is used without the express permission of the owner;
4. User registration
4.1 Users of the Website can take an eligibility check which is the first step of the registration process to becoming a member of the Website.
4.2 When registering, users must make sure that their information is correct to the best of their knowledge. Please see the privacy policy as to the information that we will hold on you.
4.3 You must not impersonate or try to impersonate another person
4.4 Users information is then looked at and either approved or denied as a potential member. If approved, the user can continue to membership registration. If denied, the user can re-apply as many times until approved. User can contact IndEx Card support to ask for more insight to why their eligibility was denied. This decision is communicated via email.

5. User membership registration
5.1 The use of this membership is for the UK's professional performers and artists. The qualification criteria for the membership service is determined by IndEx Card UK. To qualify for a membership, users must:

be aged 18 years old and above,
-
graduated from a dance/drama college or university to a professional standard with a qualification,
-
be a UK resident,
-
not in an active contractual job as a performer or artist on time of sign up,
-
auditioning for work in the performing arts industry with an active casting profile,
5.2 Performers can have gigs/jobs that last as little as 2-24 hours. If your job is longer than 1 week in length, you are classed as employed in the industry and are not eligible for our membership.
5.3 We reserve the right to remove any member found to be breaching the eligibility criteria as listed above.
5.4 If you purchase a yearly membership, and gain employment within this year, you can continue use of IndEx Card membership until the expiry date, 1 year from purchase.
5.5 When registering, users must make sure that their information is correct to the best of their knowledge. You must not impersonate or try to impersonate another person. Please see the privacy policy as to the information that we will hold on you.
6. Membership Terms
6.1 The use of this membership is for the UK's professional performers and artists. The qualification criteria for the membership service is determined by IndEx Card UK. To qualify for a membership, users must:

be aged 18 years old and above,

auditioning for work in the performing arts industry with an active casting profile,
6.2 Registered members are responsible for the safe keeping of user names and passwords and must make sure that they take all necessary steps not to disclose information to unauthorised users. IndEx Card reserves the right to ask any of its members to change their password at any point it deems necessary to protect the account.
6.3 Members must not create multiple accounts or try to change their member ID. If a password is forgotten or lost then the user must go through the appropriate route: the forgotten password link. Members must contact IndEx Card support if this cannot be achieved, through the Help & Contact area of the website. Multiple accounts by one user will not be approved by IndEx Card staff. Email addresses can be updated by visiting the My Account area once logged in to the website.
6.4 Members must make sure that their information is correct and up to date at all times. If any change of status occurs, members are required to update their account or inform IndEx Card of any changes. Please see the privacy policy as to the information that we will hold on you.
6.5 IndEx Card reserves the right to remove any member from the site, freeze their account and revoke their membership without prior warning if it feels the member is a breach to security or could be in the future.
6.6 Members must not share discount codes and offers to anyone else. The discounts are for the sole use of the member only. IndEx Card reserves the right to remove any member found to be abusing the discount codes or any other call to actions provided, and ban them from the website. This can be conducted without consent of the member.
6.7 Members must not: impersonate or try to impersonate another person; disclose your password to anyone else; allow anyone else to use your account; or use anyone else’s account.
7. Discounts
7.1 IndEx Card provides discount codes for companies, businesses and sole traders offering goods and services. The transactions that take place with these companies, businesses and sole traders are done through their external sites and are not completed on the IndEx Card website. Therefore, it is the companies, businesses and sole traders that are responsible for the transaction security on any purchases made.
7.2 All companies listed on the IndEx Card website reserve the right to add, amend or withdraw their offer at any time.
7.3 Should an offer not work and not provide a discount, it is up to the member to contact IndEx Card to notify and report this. If a member continues with their purchase without the discount, then the member has authorised the transaction with no discount and it will be down to the company’s discretion as to whether they provide a refund on the discount amount.
7.4 IndEx Card displays links and codes for companies wanting to offer a discount to members of the service. All information on an offer page is provided directly by the company themselves and therefore IndEx Card cannot be held responsible for any errors. This includes if an offer is not working, a link is out of date or the company text incorrect.
7.5 Other advertisements contained on the IndEx Card website contain materials created and submitted by third parties. IndEx Card does not accept liability for this material or any issues that may arise from this.
7.6 The IndEx Card website contains links to third party websites that are not maintained or controlled by IndEx Card UK. Whilst IndEx Card does pick its companies carefully it cannot be held liable for any material on these sites and any illegal or wrong information on these sites.
7.7 By obtaining a promotional code or accessing an offer or discount through IndEx Card, you acknowledge that such offer or discount is subject to third party terms and conditions and it is your responsibility to review such terms and conditions before entering into any transaction with that third party.
7.8 IndEx Card uses cookies to track the sales made on third party websites by members. No personal data is passed to third party websites and we use member ID numbers that have no relationship to personal details to track with. By signing up to IndEx Card and agreeing to these terms and conditions, you agree for IndEx Card to put these cookies on to your computer/device. Please see the Cookie Policy for full details on the cookies that we use and the purposes of each.
7.9 Affiliate Networks: IndEx Card are paid by some of the retailers featured on our service when a member makes a purchase. When you click through to a retailer from our service, your browser may redirect you via an affiliate network which drops a cookie on your computer. The cookie stores tracking information so that when you visit a retailer via our service, any purchases made will result in the retailer knowing that this purchase has been referred by IndEx Card. The retailer will then send us information about your purchase. No personal information such as your name or email address is involved in this process. Whilst we do not drop the affiliate network cookie, we just wanted to tell you about it before you use our service to make a transaction.

8. Term and Termination
8.1 These Terms will remain in full force and effect while you are a User and/or member of the Website.
8.2 IndEx Card may, at any time and for any reason, terminate these Terms with you and deny you access to the Website.
8.3 In the event of termination of these Terms for any reason, you must not attempt to use the Website.

9. Intellectual Property
9.1 Other than in relation to links to third party websites and non-exclusive voucher codes, IndEx Card owns or has a licence to use all right, title and interest in and to the Website, including without limitation all copyright and any other intellectual property rights therein. Some of the content is produced in whole or in part under licence from, and based in whole or in part from, copyright material of the listed merchant. These Terms shall not be construed to convey title to or ownership of the Website or the data contained therein to any User. All rights in and to the Website not expressly granted to Users are reserved by IndEx Card.
9.2 You are expressly prohibited from: reproducing, copying, editing, transmitting, uploading or incorporating into any other materials any of the Website; and
9.2.2 removing, modifying, altering or using any registered or unregistered marks/logos owned by IndEx Card, and doing anything which may be seen to take unfair advantage of the reputation of IndEx Card or could be considered an infringement of any of the intellectual property rights owned and/or licensed to IndEx Card, without first obtaining the written permission of IndEx Card.

10. Warranties and Liabilities
10.1 IndEx Card is committed to securing great discounts. We work directly with retailers to supply members with valid discount codes. The discounts displayed on the Site are provided without any guarantees, conditions or warranties to their accuracy. To the extent permitted by law, we, and any third parties connected to us hereby expressly exclude:

All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the Site or in connection with the use, inability to use, or results of the use of the Site, any websites linked to it and any materials posted on it, including, without limitation any liability for:

loss of income or revenue;

loss of profits or contracts;

loss of anticipated savings;

loss of data;

loss of goodwill; and

wasted management or office time; and

10.2 This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
10.3 We regularly audit our discount codes. However codes may run out, or stop working. IndEx Card will contact the retailer to request new valid codes as soon as an issue emerges. IndEx Card is not responsible for the validity of codes, and if there is an issue we cannot be held liable for any losses incurred.
10.4 Discounts are usually only valid on full priced items and will often exclude sale items unless stated and other limitations set by the retailer. If a code is not working please check the retailer’s full terms and conditions.
10.5 Our discounts link to third party websites. These links are provided for your convenience to provide further information. We have no control over the contents of those websites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
10.6 The information provided on the Website by IndEx Card is intended as information only and does not constitute advice. Therefore, it must not be relied on to assist in making or refraining from making a decision, or to assist in deciding on a course of action.
